Terms of Service

Welcome to Perkly. These Terms of Service ("Terms") govern your access to and use of the website located at perkly.ae and any related tools, features, and services we provide (together, the "Service").

Perkly ("Perkly", "we", "us", or "our") operates the website at perkly.ae and is based in Dubai, United Arab Emirates.

Please read these Terms carefully. By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Disclaimer, which are incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.

Acceptance by starting the Wizard. Starting our card-matching tool (the "Wizard"), by selecting "Find the best card", "Get started", or any other link or button that opens it, constitutes your automatic and binding acceptance of all of the terms, policies, and notices in our Terms & Policies section (available at perkly.ae/legal), including these Terms of Service, the Privacy Policy, the Cookie Policy, the Disclaimer, the Disclosure, the Acceptable Use & Fair Usage Policy, and the Intellectual Property & Copyright Notice. If you do not agree to all of them, do not start the Wizard.

1. Definitions

In these Terms:

  • "Content" means all information, data, text, recommendations, results, software, code, designs, graphics, logos, databases, and other materials made available on or through the Service.
  • "Recommendation" means any suggestion, match, result, or output the Service generates based on information you provide.
  • "User", "you", or "your" means any person who accesses or uses the Service.
  • "Provider" means any bank, card issuer, financial institution, or other third party whose products may be referenced on the Service.

2. Eligibility

2.1. You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

2.2. The Service is intended for use by residents of the United Arab Emirates. While the Service may be accessible elsewhere, we make no representation that it is appropriate or available for use in any other location, and you are responsible for compliance with any laws applicable to you.

3. What Perkly Is and What It Is Not

3.1. Perkly is an information and matching tool. The Service collects high-level, non-sensitive information that you choose to provide (such as income range, general spending patterns, and product preferences) and uses it to suggest financial products that may fit your profile. That is the entire function of the Service.

3.2. Perkly is not a bank, financial institution, lender, broker, intermediary, or licensed financial advisor. We do not issue, sell, distribute, or arrange any financial product, and we do not hold any client funds.

3.3. Perkly does not provide financial, investment, legal, tax, or other professional advice. Recommendations are informational suggestions only, generated automatically from the information you provide. They are not personalised financial advice, do not take into account your full financial circumstances, and do not create any advisor-client, fiduciary, or similar relationship between you and Perkly.

3.4. Perkly is independent. Unless expressly stated on the Service, Perkly is not affiliated with, endorsed by, or sponsored by any Provider. References to a Provider or its products do not imply any partnership or endorsement in either direction.

3.5. You are solely responsible for any decision you make and any action you take based on a Recommendation. Before applying for or relying on any financial product, you should review the Provider's own terms and, where appropriate, seek advice from a qualified, licensed professional.

4. No Warranty on Accuracy of Information

4.1. Financial products change constantly. Features, fees, reward structures, eligibility criteria, interest rates, terms, and availability are set by Providers and may change at any time without notice to us.

4.2. While we make reasonable efforts to keep information current, we do not warrant, guarantee, or represent that any Content on the Service is accurate, complete, current, or free from error. Content may be outdated or incorrect at any given time.

4.3. You must verify all product details directly with the relevant Provider before making any decision or application. The Provider's own published terms always prevail over anything shown on the Service. Perkly is not responsible for any discrepancy between Content on the Service and a Provider's actual product, or for any loss arising from reliance on outdated or inaccurate Content.

4.4. The Service is provided on an "as is" and "as available" basis. We do not guarantee that a Recommendation will be suitable for you, that you will be approved for any product, or that any particular outcome or saving will result.

5. Your Responsibilities

5.1. The quality of any Recommendation depends entirely on the accuracy of the information you provide. You agree to provide accurate and honest information and acknowledge that Recommendations based on inaccurate input may not be appropriate for you.

5.2. You are responsible for maintaining the confidentiality of any access you have to the Service and for all activity that occurs under your access.

5.3. You agree to use the Service only for your own lawful, personal, non-commercial purposes and in accordance with these Terms.

6. Acceptable Use and Prohibited Conduct

The Service is licensed to you for personal, non-commercial use only. You agree that you will not, and will not attempt to, do any of the following:

6.1. Commercial exploitation. Use the Service, any Recommendation, or any Content for any commercial purpose outside of Perkly's own intended use, including, without limitation, providing advisory, consultancy, comparison, or referral services to any third party, whether for a fee or otherwise, on the back of the Service.

6.2. Resale and redistribution. Sell, resell, licence, sub-licence, rent, lease, syndicate, republish, distribute, or otherwise make available the Service, any Recommendation, or any Content to any third party.

6.3. Automated access and scraping. Use any robot, spider, crawler, scraper, bot, script, browser plugin, or other automated means to access, query, monitor, copy, harvest, mine, or extract any part of the Service or its Content; or conduct any systematic or bulk collection of data from the Service.

6.4. Copying the platform. Copy, reproduce, duplicate, frame, mirror, or otherwise replicate any part of the Service, its database of products, its matching logic, its design, or its underlying technology.

6.5. Reverse engineering. Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, structure, algorithms, or methods of the Service.

6.6. Building a competing service. Use the Service or any Content to develop, train, populate, or operate any product or service that competes with Perkly.

6.7. Circumventing controls. Circumvent, disable, or interfere with any usage limit, rate limit, security feature, or access control, or use the Service in a way intended to evade detection.

6.8. Service abuse and excessive use. Use the Service in any manner that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure, degrades performance, or interferes with other users' enjoyment of the Service.

6.9. Unlawful or harmful use. Use the Service for any unlawful, fraudulent, deceptive, or harmful purpose; introduce any virus, malware, or other malicious code; or attempt to gain unauthorised access to any part of the Service, its servers, or any connected system.

6.10. Misrepresentation. Misrepresent your identity, impersonate any person or entity, or provide false information in a manner intended to manipulate or abuse the Service.

7. Fair Usage

7.1. To protect the integrity and availability of the Service for all users, we operate a fair usage approach. We reserve the right, in our sole discretion, to determine what constitutes excessive, abusive, or improper use.

7.2. We may apply technical measures (including rate limits, query caps, and access restrictions) to prevent use that is disproportionate to normal individual use, and to detect and prevent the conduct prohibited in Section 6.

7.3. We may set, vary, or remove usage limits at any time without notice. We are not obliged to publish specific thresholds.

8. Intellectual Property

8.1. The Service and all Content (including the "Perkly" name and wordmark, logos, brand assets, the product database, the matching logic, software, design, text, and graphics) are owned by or licensed to Perkly and are protected by intellectual property and other laws. All rights are reserved.

8.2. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sub-licensable, revocable licence to access and use the Service for your own personal, non-commercial purposes only. No other rights are granted to you, whether by implication or otherwise.

8.3. You acquire no ownership of any Content. Any use of the Service or Content not expressly permitted by these Terms is strictly prohibited and may infringe our rights.

9. Suspension, Restriction, and Termination

9.1. We may, at our sole discretion and at any time, with or without notice, restrict, suspend, throttle, or terminate your access to all or part of the Service (including by blocking specific user accounts, devices, or IP addresses) where we reasonably believe that you have breached these Terms, engaged in any prohibited conduct, or otherwise misused the Service.

9.2. We may take such action immediately and without prior warning in cases of clear or serious abuse, including unauthorised commercial use, scraping, security violations, or intellectual property infringement.

9.3. Suspension or termination does not limit any other right or remedy available to us, including those in Section 10.

10. Abuse and Legal Action

10.1. Misuse of the Service is taken seriously. Any breach of these Terms (in particular unauthorised commercial use, resale or redistribution, scraping or automated extraction, copying of the platform or its database, reverse engineering, infringement of our intellectual property, or any attempt to harm or compromise the Service) may result in legal action against you.

10.2. We reserve the right to pursue all remedies available to us under the laws of the United Arab Emirates, including injunctive relief and claims for damages.

10.3. You agree that you will be liable for, and will reimburse Perkly for, any losses, damages, costs, and expenses (including reasonable legal fees) that we incur as a result of your breach of these Terms or misuse of the Service.

10.4. We reserve the right to retain and disclose information relating to suspected abuse to law enforcement or other competent authorities where permitted or required by law.

11. Disclaimer of Warranties

11.1. To the maximum extent permitted by applicable law, the Service and all Content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement.

11.2. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that any Recommendation will meet your requirements or produce any particular result.

12. Limitation of Liability

12.1. To the maximum extent permitted by applicable law, Perkly, its owners, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, savings, data, goodwill, or opportunity, arising out of or in connection with your use of, or inability to use, the Service or any reliance on any Content or Recommendation, whether based on contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

12.2. Without limiting Section 12.1, and to the maximum extent permitted by applicable law, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed AED 200 (two hundred UAE dirhams).

12.3. Any financial decision you make is your own. We are not liable for any product you apply for, any decision a Provider makes, or any outcome of your dealings with any Provider.

12.4. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Perkly and its owners, officers, employees, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your breach of these Terms, your violation of any law, or your infringement of any third-party right.

14. Third-Party Products and Links

14.1. The Service may reference or link to products, websites, or resources operated by Providers or other third parties. These are provided for convenience only.

14.2. We do not control and are not responsible for the content, products, terms, privacy practices, or availability of any third party. Any dealings you have with a third party (including any application, agreement, or transaction) are solely between you and that third party, and are subject to that third party's own terms.

15. Privacy

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect information. By using the Service, you consent to those practices.

16. Changes to the Service and to These Terms

16.1. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice.

16.2. We may update these Terms from time to time. The "Last updated" date at the top indicates when the latest version took effect. Changes are effective when posted. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

17. General

17.1. Governing law. These Terms are governed by the laws of the United Arab Emirates.

17.2. Jurisdiction. You agree that the courts of Dubai, United Arab Emirates, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.

17.3. Severability. If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17.4. No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

17.5. Assignment. You may not assign or transfer these Terms. We may assign these Terms to any successor or affiliate.

17.6. Entire agreement. These Terms, together with the Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and Perkly regarding the Service and supersede any prior agreements.
