Acceptable Use & Fair Usage Policy

This Acceptable Use & Fair Usage Policy (this "Policy") sets out how you may and may not use the website at perkly.ae and our related tools (the "Service") operated by Perkly ("Perkly", "we", "us", or "our"), based in Dubai, United Arab Emirates.

This Policy forms part of, and is incorporated into, our Terms of Service. Any breach of this Policy is a breach of our Terms of Service. By using the Service, you agree to comply with this Policy.

1. Personal, Non-Commercial Use

The Service is provided to you for your own lawful, personal, non-commercial use only. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for that purpose. Any other use requires our prior written permission.

2. Prohibited Conduct

You agree that you will not, and will not attempt to, do any of the following:

2.1. Commercial exploitation. Use the Service, any recommendation, or any content for any commercial purpose outside of Perkly's own intended use, including providing advisory, consultancy, comparison, or referral services to any third party, whether for a fee or otherwise, on the back of the Service.

2.2. Resale and redistribution. Sell, resell, licence, sub-licence, rent, lease, syndicate, republish, distribute, or otherwise make available the Service, any recommendation, or any content to any third party.

2.3. Automated access and scraping. Use any robot, spider, crawler, scraper, bot, script, browser plugin, or other automated means to access, query, monitor, copy, harvest, mine, or extract any part of the Service or its content; or conduct any systematic or bulk collection of data from the Service.

2.4. Copying the platform. Copy, reproduce, duplicate, frame, mirror, or otherwise replicate any part of the Service, its database of products, its matching logic, its design, or its underlying technology.

2.5. Reverse engineering. Decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code, structure, algorithms, or methods of the Service.

2.6. Building a competing service. Use the Service or any content to develop, train, populate, or operate any product or service that competes with Perkly.

2.7. Circumventing controls. Circumvent, disable, or interfere with any usage limit, rate limit, security feature, or access control, or use the Service in a way intended to evade detection.

2.8. Service abuse and excessive use. Use the Service in any manner that imposes, or may impose, an unreasonable or disproportionately large load on our infrastructure, degrades performance, or interferes with other users' enjoyment of the Service.

2.9. Unlawful or harmful use. Use the Service for any unlawful, fraudulent, deceptive, or harmful purpose; introduce any virus, malware, or other malicious code; or attempt to gain unauthorised access to any part of the Service, its servers, or any connected system.

2.10. Misrepresentation. Misrepresent your identity, impersonate any person or entity, or provide false information in a manner intended to manipulate or abuse the Service.

3. Fair Usage

3.1. To protect the integrity and availability of the Service for all users, we operate a fair usage approach. We reserve the right, in our sole discretion, to determine what constitutes excessive, abusive, or improper use.

3.2. We may apply technical measures (including rate limits, query caps, and access restrictions) to prevent use that is disproportionate to normal individual use, and to detect and prevent the conduct prohibited in Section 2.

3.3. We may set, vary, or remove usage limits at any time without notice, and we are not obliged to publish specific thresholds.

4. Monitoring

We monitor activity on the Service to operate it, maintain its security, and detect and prevent abuse and breaches of this Policy. How we handle the information collected through this monitoring is explained in our Privacy Policy and Cookie Policy.

5. Enforcement

5.1. We may, at our sole discretion and at any time, with or without notice, restrict, suspend, throttle, or terminate your access to all or part of the Service (including by blocking specific user accounts, devices, or IP addresses) where we reasonably believe that you have breached this Policy, engaged in any prohibited conduct, or otherwise misused the Service.

5.2. We may take such action immediately and without prior warning in cases of clear or serious abuse, including unauthorised commercial use, scraping, security violations, or intellectual property infringement.

5.3. These rights are in addition to, and do not limit, any other right or remedy available to us.

6. Abuse and Legal Action

6.1. Misuse of the Service is taken seriously. Any breach of this Policy (in particular unauthorised commercial use, resale or redistribution, scraping or automated extraction, copying of the platform or its database, reverse engineering, infringement of our intellectual property, or any attempt to harm or compromise the Service) may result in legal action against you.

6.2. We reserve the right to pursue all remedies available to us under the laws of the United Arab Emirates, including injunctive relief and claims for damages.

6.3. You agree that you will be liable for, and will reimburse Perkly for, any losses, damages, costs, and expenses (including reasonable legal fees) that we incur as a result of your breach of this Policy or misuse of the Service.

6.4. We reserve the right to retain and disclose information relating to suspected abuse to law enforcement or other competent authorities where permitted or required by law.

7. Reporting Abuse

If you become aware of any misuse of the Service, or believe someone is using the Service in breach of this Policy, please report it to us at admin@perkly.ae.

8. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date at the top shows when the latest version took effect. Changes are effective when posted. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Policy.
